By accessing or using the Scalogy website (scalogy.com) or any of our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the site or services.

Scalogy ("we," "our," or "us") provides AI-powered automation services for small businesses, including lead response, scheduling, follow-up, and analysis automations. We are based in Fayetteville, Georgia, United States, and serve the Atlanta metro and clients nationwide.

You must be at least 18 years old and legally capable of entering into a binding contract to use our services. By using Scalogy, you represent that you meet these requirements.

We offer custom AI agent build-outs and a hosted platform ("Scalogy Platform") that runs your automations. Specific service deliverables, fees, and timelines are set out in a separate written engagement or order form. These Terms govern your general use of the website and platform; project-specific terms supersede where they conflict.

You agree NOT to:

• Use the site or services for any unlawful, fraudulent, or harmful purpose
• Attempt to reverse-engineer, scrape, or disrupt our infrastructure
• Send unsolicited bulk messages (spam) through any Scalogy-provided channel
• Impersonate another person or misrepresent your affiliation
• Upload malicious code, viruses, or content that violates third-party rights
• Use our services to harvest personal data without consent

If you provide your phone number to us (via form, voice call, or otherwise), you consent to receive transactional and conversational SMS messages from Scalogy at that number, including appointment confirmations, support replies, and follow-ups directly tied to your inquiry. Message and data rates may apply. You can opt out at any time by replying STOP to any of our messages, or by emailing [email protected]. Reply HELP for assistance. We do not sell or share mobile information with third parties for marketing purposes.

If you create an account on our platform, you are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access.

Fees for the Scalogy Platform and project work are described on our pricing page or in your written engagement. Subscription fees are billed in advance and are non-refundable except where required by law. You authorize us to charge the payment method you provide for all applicable fees.

The Scalogy name, logo, website content, software, and platform are owned by Scalogy and protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable license to use the services solely for their intended business purpose. You retain ownership of content you provide; you grant us a license to use that content as needed to deliver the services.

Our platform integrates with third-party services (e.g., email providers, Twilio, analytics, AI model providers). Your use of those services is subject to their own terms. We are not responsible for the availability, accuracy, or content of third-party services.

The site and services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the services will be uninterrupted, error-free, or that AI outputs will be accurate or suitable for every use case. You are responsible for reviewing AI-generated content before relying on it.

To the maximum extent permitted by law, Scalogy and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability for any claim arising out of these Terms or the services will not exceed the amount you paid us in the twelve (12) months preceding the claim.

You agree to defend, indemnify, and hold harmless Scalogy from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of your use of the services or your violation of these Terms.

We may suspend or terminate your access to the services at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the services at any time. Sections 5, 9, 11, 12, 13, 15, and 16 survive termination.

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law principles. Any dispute arising under these Terms will be resolved exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to that jurisdiction.

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the site or services after changes constitutes acceptance of the revised Terms.
